Update on the FADP – Developments in 2025–2026
The application of the Federal Act on Data Protection (FADP) has become part of everyday practice again. Thomas Steiner’s overview of the law and practice of the courts and the Federal Data Protection and Information Commissioner (FDPIC) from May 2025 to April 2026 highlights many familiar aspects and provides some clarifications regarding the right of access and the application of data processing principles. There are also welcome clarifications regarding the lawfulness of the use of cookies.
New, or at least more emphasized, is the focus of the FDPIC and the courts on image and voice data (conclusion of the preliminary investigation regarding intelligent video surveillance cameras at Coop, investigation concerning the use of bodycams in public transportation, and voiceprint authentication at PostFinance).
